He holds a federal permit to work in the United States and is protected by a 2019 court order that explicitly barred Garcia from ever being sent back to El Salvador. The Trump administration, however, alleges <\/span><span style=\"font-weight: 400\">that Garcia is an active member of MS-13 according to the <\/span><a href=\"https:\/\/apnews.com\/article\/trump-deportation-abrego-garcia-el-salvador-adc6976c9e294b4c4b45d5a692112066\"><span style=\"font-weight: 400\">The Associated Press<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><a href=\"https:\/\/www.politico.com\/news\/2025\/04\/22\/dems-see-a-winning-issue-in-case-of-man-mistakenly-deported-to-el-salvador-00302246\"><span style=\"font-weight: 400\">Politico<\/span><\/a> <span style=\"font-weight: 400\">notes that critics continue to cite due process and rule of law, both of which have been upended by the Trump administration\u2019s deportation of Garcia. <\/span><a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/man-was-sent-el-salvador-due-administrative-error-protected-legal-stat-rcna199010\"><span style=\"font-weight: 400\">NBC News<\/span><\/a> <span style=\"font-weight: 400\">finds that Garcia\u2019s <\/span><span style=\"font-weight: 400\">lawyers have argued that the government \u201chas never produced an iota of evidence to support this unfounded allegation.\u201d Despite this, and despite Garcia never being convicted in any court or on any document, Vice President JD Vance <\/span><a href=\"https:\/\/x.com\/JDVance\/status\/1906934067607556440\"><span style=\"font-weight: 400\">posted on X<\/span><\/a> <span style=\"font-weight: 400\">that \u201cMy comment is that according to the court document you apparently didn\u2019t read he was a convicted MS-13 gang member with no <\/span><span style=\"font-weight: 400\">legal right to be here.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The court document that JD Vance is potentially referring to, as he never cites which document contains the information, is most likely a document involved in the 2019 court proceeding titled \u201cgang field interview sheet.\u201d <\/span><a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/new-documents-government-case-mistakenly-deported-abrego-garcia-gang-rcna201665\"><span style=\"font-weight: 400\">NBC News<\/span><\/a><span style=\"font-weight: 400\">, details how this document, used by the police and <\/span><span style=\"font-weight: 400\">involved in Garcia\u2019s 2019 court proceeding, lists the police had a \u201creliable confidential source.\u201d This document, not officially produced by the court and only used by the police, did not hold up in court against Garcia. <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/c20z63gr8mzo\"><span style=\"font-weight: 400\">BBC News<\/span><\/a> <span style=\"font-weight: 400\">notes that Judge Paula Xinix has labeled this document as a \u201csingular unsubstantiated allegation\u201d that didn\u2019t hold up in court the first time.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The utilization of this document by the Trump administration to condemn and then deport Garcia brings with it questions about the Fifth Amendment of the U.S. Constitution. <\/span><a href=\"https:\/\/www.law.cornell.edu\/wex\/double_jeopardy#%3A~%3Atext%3DThe%20Double%20Jeopardy%20Clause%20in%2Cfor%20substantially%20the%20same%20crime%20\"><span style=\"font-weight: 400\">The Legal <\/span><\/a><a href=\"https:\/\/www.law.cornell.edu\/wex\/double_jeopardy#%3A~%3Atext%3DThe%20Double%20Jeopardy%20Clause%20in%2Cfor%20substantially%20the%20same%20crime%20\"><span style=\"font-weight: 400\">Information Institute<\/span><\/a> <span style=\"font-weight: 400\">defines the Double Jeopardy Clause in the Fifth Amendment as prohibiting anyone from being prosecuted twice for the same crime. Gracia, who has already been found <\/span><span style=\"font-weight: 400\">innocent of MS-13 connections in court the first time, is being condemned without trial and was deported for the same alleged crime. Additionally, the power of the judiciary branch is now <\/span><span style=\"font-weight: 400\">under question.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This condemnation also comes with a promise from the Trump administration that Garcia will never live in the United States again. <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/c20xzdxk53no\"><span style=\"font-weight: 400\">BBC News<\/span><\/a> <span style=\"font-weight: 400\">reports on how despite a judge ordering the <\/span><span style=\"font-weight: 400\">Trump administration to secure Garcia\u2019s return to the United States, White House press secretary Karoline Leavitt has stated that <\/span><span style=\"font-weight: 400\">\u201c<\/span><span style=\"font-weight: 400\">If he [Garc\u00eda] ever ends up back in the United States, he would immediately be deported again. He will never live in the United States of America.&#8221;<\/span><span style=\"font-weight: 400\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400\">Additionally, the case of Garcia is not only a one-time error. <\/span><a href=\"https:\/\/abcnews.go.com\/US\/judge-orders-return-2nd-migrant-deported-el-salvador\/story?id=121110233\"><span style=\"font-weight: 400\">ABC News<\/span><\/a> <span style=\"font-weight: 400\">reports that U.S. District Judge Stephanie Gallagher has ordered the Trump administration to return another deported <\/span><span style=\"font-weight: 400\">migrant who had a court settlement that was similar to Garcia\u2019s. She is quoted as saying &#8220;like Judge [Paula] Xinis in the Abrego Garcia matter, this court will order Defendants to facilitate Cristian&#8217;s return to the United States so that he can receive the process he was entitled to under the parties&#8217; binding Settlement Agreement.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400\">While the deportations are sparking controversy on both sides, and both the Trump <\/span><span style=\"font-weight: 400\">administration and its critics are digging in their heels, Sen. Chris Van Hollen, D-MD visited Garcia. <\/span><a href=\"https:\/\/www.npr.org\/2025\/04\/20\/g-s1-61475\/trump-faces-bipartisan-criticism-over-abrego-garcia-deportation\"><span style=\"font-weight: 400\">NPR<\/span><\/a> <span style=\"font-weight: 400\">quotes Van Hollen as having two takes on the controversy. Firstly, that the <\/span><span style=\"font-weight: 400\">documents referenced by the Trump Administration need to be tested in the court before anyone can be proclaimed guilty.
