After eating, Dr. Tangsuan began to suffer an anaphylactic attack and collapsed. She died in a nearby hospital.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, according to <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/aug\/14\/disney-wrongful-death-lawsuit\"><span style=\"font-weight: 400\">The Guardian<\/span><\/a><span style=\"font-weight: 400\">, Disney had requested that the matter be settled out of court due to an arbitration clause in the terms and conditions Piccolo agreed to when he briefly signed up for a one-month trial subscription to Disney+ in 2019, and again when he used his Disney+ account last year to buy the park tickets. Disney claims that Piccolo agreed to Disney\u2019s terms of use, which state that users agree to settle any disputes with the company out of court through arbitration.\u00a0But, following multiple news reports and subsequent backlash, Disney has withdrawn its request, allowing for the case to be heard in front of a jury, according to <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/08\/20\/nyregion\/disney-arbitration-allergy-death-lawsuit.html\"><span style=\"font-weight: 400\">The New York Times<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Josh D\u2019Amaro, chairperson of Disney\u2019s theme park division, told <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/cr7r9djxj0do\"><span style=\"font-weight: 400\">BBC News<\/span><\/a><span style=\"font-weight: 400\">, &#8220;We believe this situation warrants a sensitive approach to expedite a resolution for the family who have experienced such a painful loss.&#8221; Then agreed to waive the Company\u2019s arbitration clause and have the case proceed in court.<\/span><\/p>\n<p><span style=\"font-weight: 400\">According to <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/cr7r9djxj0do\"><span style=\"font-weight: 400\">BBC News<\/span><\/a><span style=\"font-weight: 400\">, in arbitration, a neutral third party oversees a dispute, benefiting those who want to avoid a lengthy trial. Now, a jury is able to hear the evidence. Brian Denney, Piccolo\u2019s lawyer said, &#8220;Attempts by corporations like Disney to avoid jury trials should be looked at with skepticism.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Many speculate that Disney\u2019s reversal comes from the \u201cadverse publicity\u201d generated by its initial legal strategy, including Jamie Cartwright, a partner at the law firm Charles Russell Speechlys.\u00a0Cartwright told <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/cr7r9djxj0do\"><span style=\"font-weight: 400\">BBC News<\/span><\/a><span style=\"font-weight: 400\"> that Disney\u2019s attempt to make the situation private pushed the already-tenuous lawsuit into a bad spotlight in the public, which most likely prompted the entertainment company to drop its request and allow the case to be heard by a jury.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The case began in October 2023, when Piccolo, Dr. Tangsuan, and her mother ate at Raglan Road Irish Pub and Restaurant. They allegedly chose the restaurant because Disney and the restaurant advertised that accommodating those with food allergies was a top priority, reports <\/span><a href=\"https:\/\/www.reuters.com\/legal\/disney-agrees-have-florida-wrongful-death-lawsuit-decided-court-2024-08-20\/\"><span style=\"font-weight: 400\">Reuters<\/span><\/a><span style=\"font-weight: 400\">. Because of Dr. Tangsuan\u2019s severe allergies to nuts and dairy, the couple continuously asked the restaurant\u2019s waiter for reassurance that their food was allergen-free. When their orders, including dishes, arrived without allergen-free flags, the server assured Dr. Tangsuan that the dishes were safe to eat, according to <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/08\/20\/nyregion\/disney-arbitration-allergy-death-lawsuit.html\"><span style=\"font-weight: 400\">The New York Times<\/span><\/a><span style=\"font-weight: 400\">.\u00a0But less than an hour after finishing their dinner, Dr. Tangsuan had difficulty breathing and self-administered an EpiPen.
