Other opposition parties have accused Mo\u00efse of dictatorial actions, citing the dissolution of the parliament in 2020 and the recent removal of three Supreme Court Justices.<\/p>\n<p>The controversy concerning Mo\u00efse\u2019s term length stems from a contested election due to allegations of fraud in 2015. \u00a0Mo\u00efse was officially elected in 2016; however, he did not take office until February 2017. Protesters have cited a provision in the Haitian Constitution that \u201cstarts the clock once a president is elected, rather than when he takes office,\u201d reports <a href=\"https:\/\/www.cnn.com\/2021\/02\/21\/americas\/haiti-protests-continue-intl\/index.html\">CNN<\/a>. Mo\u00efse countered this assertion, saying that the Haitian Constitution lacks clarity.<\/p>\n<p>Amidst the constitutional confusion, Mo\u00efse has established a new electoral council and committee to redraft the existing constitution, according to <a href=\"https:\/\/www.newyorker.com\/news\/news-desk\/haitians-are-at-an-impasse-over-the-countrys-future\">The New Yorker<\/a>. The rewriting of the Haitian Constitution is meant to be Mo\u00efse\u2019s legacy project to make future governance more effective. However, many are concerned about the legitimacy of rewriting the constitution without parliamentary and institutional checks-and-balances.<\/p>\n<p>In the current constitution, there is a provision that prevents presidents from holding office for consecutive terms. However, there is no limit on the number of times that one can hold office. This provision is meant to reduce the possibility of authoritarian rule in Haiti. The New Yorker reports that in the most recent draft released by Mo\u00efse\u2019s committee, there is no \u201cprohibition against consecutive Presidential terms.\u201d This is a major concern for many Haitians who remember the 29-year term characterized by a violent military presence held by the father-son duo, Francois and Jean-Claude Duvaulier, from 1957 to 1986.<\/p>\n<p>Although some members of the international community, including the United Nations and the Biden administration, have supported Mo\u00efse\u2019s term ending in 2022, that support may be dwindling. Prior to the removal of the Supreme Court Justices, <a href=\"https:\/\/www.france24.com\/en\/live-news\/20210215-thousands-of-haitians-protest-alleging-new-dictatorship\">France24<\/a> reports that State Department spokesman Ned Price said &#8220;a new elected president should succeed President Moise when his term ends on February 7, 2022.\u201d However, <a href=\"https:\/\/apnews.com\/article\/jovenel-moise-courts-democracy-elections-latin-america-491e2d3b3ec2beab0674e5021d2ccb28\">AP<\/a> reports a change in the Biden administration\u2019s stance, citing acting U.S. Deputy Ambassador Jeffrey DeLaurentis who said the Biden administration \u201cis disturbed that Haiti\u2019s prolonged period of rule by decree continues.\u201d AP further reports that DeLaurentis \u201curged Haiti\u2019s government to hold overdue legislative elections \u2018as soon as possible.\u2019\u201d<\/p>\n<p>The U.S. Ambassador to Haiti, Michele Sison, has also expressed \u201cconcern about Moise&#8217;s unilateral moves,\u201d according to <a href=\"https:\/\/www.voanews.com\/americas\/haiti-responds-us-state-dept-tweet-urging-respect-democratic-norms\">VOA<\/a>. The dissolution of the parliament in 2020 and the subsequent failure of Mo\u00efse to hold legislative elections challenges the country\u2019s democratic norms. Many have seen Moise\u2019s actions as an attempt to gain more power prior to elections scheduled for September 2021. The New Yorker continues that Mo\u00efse has established a National Intelligence Agency \u201cwhose agents are immune from prosecution.\u201d They report that he has \u201creinstated\u00a0the Haitian Army, whose leaders have been accused of massacres and other grave human rights violations.\u201d Attacks on journalists by police and military personnel have also increased, resulting in widespread criticism against Mo\u00efse for his lack of intervention.<\/p>\n<p>Mo\u00efse and his administration stand by their decisions. When Mo\u00efse took office, gang activity was rampant in Haiti. The oligarchs in the country were opposed to prosecuting and dissolving gangs due to corruption in the utility and energy sectors. As a result of a presidential decree, Mo\u00efse was able to institute \u201creforms in the utility sector and purchase of petrol and dismantled 64 of the 100 existing gangs the oligarchs support,\u201d continues AP.
